LOCAL UNION 67 BY-LAWS
AS AMENDED January 1, 2009

ARTICLE I
MEETINGS
1.01   That the union meetings be adjourned at 10:00 p.m. or at the end of the regular agenda, unless there is a vote from the floor to extend them in thirty minute intervals. It will require a two-thirds majority to extend the time to adjourn.

1.02   Any member continually disturbing the Local Union Meetings shall, after warning, be fined ($25.00) Twenty-Five Dollars, and removed from the hall.

1.03   Regular and special called membership meetings of Local 67 shall require a Quorum of 25 members in good standing.

1.04   These Local By-laws may only be changed by a motion in writing being put to the regular meeting giving notice of same. If passed at next Called Meeting, same will be incorporated when By-laws are changed yearly in the month of April. It shall require a two-thirds majority vote to carry any change or addition.

1.05   All motions must be submitted in writing to the Recording Secretary and include the date, name and card number of the mover as well as their signature.

1.06   A financial meeting or meetings occur annually within a 6 month period after years' end; to show the membership on an overhead screen the audit of each area of monies collected from our paycheck. An auditor should be present at these meetings to answer any questions about the financial matters put forward from the membership. If an actuary is required for our pension area of monies then he or she should also be present.

1.07   All new members to Local 67 be voted in at regular monthly meetings.

1.08   Once a year there should be a called meeting to discuss a proposal budget for the next year, as well as how we stayed on budget for the past year. All aspects of expenditures and expenses should be included.

1.09   Any notices of motions pertaining to wage and benefit schedules or monetary issues be dealt with at a called meeting in March of each calendar year, so as to allow time to structure the wage schedules that become effective on May 1st of each year.

1.10   Monthly meetings in July be suspended due to vacations and poor attendance.

ARTICLE II
DISPATCHING

2.01   An unemployed member MUST sign the appropriate out of work list or slip denoting his branch of the trade. Any member found to have made a false statement on said list will be fined ($300.00) Three Hundred Dollars, and his name removed from the inappropriate list and placed on the bottom of the appropriate list.

2.02   Any member who is over (3) months (U.A. Constitution) in arrears with his dues is a suspended member and shall be removed from the job. The business representative will not be allowed to send any suspended member to work on any job before his dues and assessments are paid to date, unless the member has appeared before the executive Board and been granted permission to go to work.

2.03

2.04   Any member accepting a listed job for out-of-town work and neglects to show up for that accepted job could lose his place on the out-of-work list after a hearing by the Local Executive Board.

2.05   Unemployed members may sign the out of work list or slip from 8:00 a.m. to 5:00 p.m. Monday to Thursday, and 8:00 a.m. to 1:00 p.m. Friday. Once a member accepts a referral slip from the Union Hall, his name will be removed from the out of work list, unless he can prove extenuating circumstances beyond his control.

2.06   When a member leaves town on a travel card his name will remain on the out of work list until he re-deposits his travel card, only then will he be active for work as per Article No. 7.

2.07   A member in his third month of arrears shall only be permitted to pay his dues by–

  1. Cash;
  2. Postal Order;
  3. Certified Cheque.

2.08   All transfer card members are to appear before the executive Board (in conjunction with the Business Manager to prove validity).

2.09   Travel card members working within the jurisdiction of Local 67 shall not move from the project to which they were dispatched nor change employers unless permitted to do so by the full time officers.

2.10   Any owner/member having an interest in a company or companies must divest his involvement of same to sign Local 67's out-of-work list.. A letter from a Notary Public or lawyer stating this to be factual and true, must be submitted to the Business Manager. Any violations of this By-law must be referred to the Executive Board for appropriate action. Maximum fine for this By-law not to exceed ($1,000.00)One Thousand Dollars.

2.11   Any member who belongs to both the UA and any other trade local or trade affiliate, must inform the local unions either or that they are working and that they are not seeking employment thru that union. So as to have their name removed from the out of work list until they are no longer employed and wish to return.

2.12   That as of July 1st, 2003 Local 67 institutes a retiree's list. When a Local 67 member retires at his normal retirement date, i.e. 62 years of age or older, and is receiving a pension benefit arising from a union agreement or an employer generated pension, he shall be allowed to sign only this list and be required to pay only Retirement dues. In the event that calls to Local 67 for manpower are not filled after 2nd call Monday to Friday, then the dispatcher will call the retiree's list starting at Row 1 and continue until all retirees wishing to go to work have been dispatched. Any calls not filled shall then be available to travel cards.
Further, any member currently on the active out of work list and receiving the aforementioned pension or pensions shall have the option to stay on the active list or sign the retiree's list under those conditions, but with no right to return to the active list.

ARTICLE III
WORKING RULES

3.01   Working slips to be obtained by only unemployed members before starting work. Foremen must NOT start a man to work without a slip. Slip must be given to the Steward personally before starting to work. If there is no Steward on the job, work slip must be given to the U.A. Foreman. Maximum fine of ($150.00) One Hundred and Fifty Dollars for failure to comply with this By-law.

3.02   Work cards or dues cards shall be carried by all U.A. members and must be shown on request.

3.03   All work excluding Plumbing and Steamfitting shall be classed as open work and shall be manned by members of the U.A. with Ontario trade certification.

3.04   Any member working for a signatory contractor at any capacity, where benefits are paid on his behalf to Local 67 Benefit Plans, will be considered working out of Local 67 Union Hall, and will have his name removed from the out of work list.

3.05   As of May 1st, 1993, any member who seeks employment outside the U.A. jurisdiction as described in section l98(B) of the U.A. Constitution, must first obtain approval from this Local Union Executive Board prior to commencing work. If such approval is granted, said member will be removed from the appropriate out of work list and only upon completion of said type of work will the mem­ber be eligible to resign the appropriate out of work list.

3.06   No member of this local union shall use his vehicle to the interest of his employer or to the detriment of his fellow member.

3.07   All members are governed by a working agreement with the employer and any member knowing of working being done contrary to the agreement, the U.A. Constitution or Local 67 By-laws must report the matter to the Business Manager or Representative.

3.08   Any member found guilty of working contrary to the Local Collective Bargaining Agreement or to the detriment of Local 67 shall be fined by the Executive Board a minimum of ($100.00) One Hundred Dollars for each conviction.

3.09   Sick dues will be as per section 133(A) of the U.A. Constitution required by Head Office and to be eligible must comply with the following:

3.10   In cases of severe financial hardships efforts will be made to keep the member in good standing after a complete review by the governing body of the Local Union.

3.11   Any member summoned to appear before the Executive Board shall be notified by Registered Mail. Any member failing to appear will be fined up to a maximum of ($500.00) Five Hundred Dollars unless prior acceptable extenuating circumstances are proven.

3.12   All Local 67 members to receive a copy of Local 67 Bylaws and sign for same.

3.13   No officer or steward shall collect dues on the job.

3.14   The duties of all members shall be to see that these Bylaws are observed and infractions will be cause for disciplinary action under the U.A. Constitution and By-laws.

3.15   Upon repeated unsatisfactory reports from employers, foremen or journeymen working with apprentices, as to work conduct, said apprentice shall be summoned before the Joint Apprentice Training Council. The finding of the Council will be reported to the Executive Board. The Joint Council may make recommendations to discipline the said apprentice. The Executive Board will report to Head Office.

3.16   Industrial work shall be defined as all work of an Indust­rial Manufacturing or process nature.

3.17   Any member of Local 67 in a supervisory capacity will not displace a journeyman member working on the tools during overtime. Failure to comply could carry a maximum fine of ($500.00) Five Hundred Dollars for each offence.

3.18   When an employee(s) are to be laid off or leave volun­tarily, the Local 67 representative on said project (supervisor or steward) to notify union hall of change via facsimile or phone message, prior to the end of that regular business day.

3.19   Any retired welder who has signed the Retirees out of work list will be paid the current amount ($125.00) to complete the M.C.A. welding test, providing they have worked out of this hall as a welder in the preceding 12 months.

ARTICLE IV
FEES

4.01   Members delinquent in dues shall pay a Fifty Dollar ($50.00) reinstatement fee plus dues up to and including current month as per section 162(A) of the U.A. Constitution.

ARTICLE V
COMMITTEES

5.01   An elected officer or committee member missing three (3) consecutive regular monthly membership meetings and/or three (3) consecutive committee meetings be asked to resign unless he can show just cause for nonattendance. Any office created shall be filled by an election of the membership as per section 122(C) of the U.A. Constitution.

5.02   All monetary requests for sporting and/or social activities be forwarded to the Social Committee for approval.

5.03   Local 67 implement a volunteer Health and Safety committee to the By-Laws. This committee would discuss important issues involving Health & Safety Legislation and job site safety; and to bring important issues forward to Joint Health and Safety Committees and Stewards.

5.04   Any new Journeyman Steamfitter, Plumber or Welder, that before they are initiated in Local 67 they be interviewed by each Examining Board for their specific Trades they applied for.

ARTICLE VI
JOB STEWARDS

6.0   Job stewards will be dismissed from the job steward's job after missing three (3) consecutive Union meetings, or stewards' meetings, unless he can prove extenuating circumstances.

6.01   Job stewards stickers to be worn on hard hat at all times.

6.02   All job stewards are urged to take courses on first aid.

6.03   Job stewards to report to the Business Manager or Representative for information as to jurisdiction as settled at pre-job conference.

6.04   Job stewards will not divulge the name of any member making a complaint to anyone unless he has the member's permission in writing.

6.05   Job stewards receiving a complaint not actually involving Local By-laws will process same only after consultation with the Business Manager or Representative.

6.06   Job stewards will be dismissed from job steward's job after missing three consecutive Union meetings unless he can prove extenuating circumstance.

6.07   Qualified job stewards shall be appointed by the Business Manager or Representatives, or may be elected by Local 67 members on the job site for a period of not more than two (2) years. At the end of that two (2) year term (maximum), said steward shall report to the Business Representative at the regular monthly meeting as close to the two year limit as possible, to allow the Business Manager or Business Agent sufficient time to appoint or have elected a new steward. All stewards must attend Local 67 stewards school when the course is available. See appendix "A".

6.08   Any project that reached a total of 25 men for at least 2 weeks, the elected or appointed Steward receive $25.00 a week per diem out of the general fund.

ARTICLE VII
APPRENTICES

7.01   Apprentice members of Local 67 shall be permitted to work at all branches and phases of the trade and must be under the supervision of a journeyman certified in that branch of the trade in order to learn all branches of that trade.

7.02   Apprentices shall attend all classes as directed by Local 67's Training Committee. Direct refusal to attend will result in the apprentice being summoned to appear before the Joint Apprentice Training Council and appropriate action taken.

7.03   Apprentice Information Steamfitters and Plumbers

7.04   Apprentice Information Welders
7.05 Training Course Rules If found any of these regulations conflict with Labour Relations Act they shall be null and void.

If a written complaint is received by the Union Office duly signed by three members of Local Union 67 in good standing:

A replacement Steward will then be established in conformity with Article No. 45 of the By-laws.

New candidates to be initiated the first meeting of each month.
